Jimmy Lai, founder of Next Digital, had his conviction overturned on appeal in a case about the illegal use of land in Tseung Kwan O Industrial Estate.
The Department of Justice has decided not to appeal.
A government spokesperson said that after comprehensively considering all factors, the Department of Justice will not take further legal action.
Justice officials say that while the breach of contract did not meet the conviction threshold for "fraud," the objective fact is that Jimmy Lai had misused public resources for private gain and should be condemned.
