Hong Kong court rules in favour of lesbian couple's parental recognition

A Hong Kong court ruled in favour of a lesbian couple's parental recognition after their son were born via IVF.

The hearing was held at the High Court on Tuesday.

The couple, identified as B and R, underwent reciprocal in-vitro fertilisation, or RIVF, in 2020, after getting married in South Africa. 

In the treatment, an egg was extracted from R and fertilised with sperm from an anonymous male donor to create an embryo. The embryo was then transferred to B's womb.

In 2021, the couple's baby boy was born in Hong Kong.

While the couple tried to register themselves as the parents of the infant, only B was recognised as the parent. The pair started a civil action at the High Court in 2022, urging the court to recognise that R is also the parent of their child.

But the court ruled R as a "parent at common law." The couple then filed a judicial review.

On Tuesday, judge Russell Coleman said parts of the city's Parent and Child Ordinance "significantly impede" the child from "representing his relationship with R to the outside world." 

Colemen also said "a reasonable  balance is not struck between the societal benefits of the measure and the inroads made into the right of the affected individuals." 

While the court has found a basis for the grant of relief, it will hear further arguments before determining on the form of the relief.
