Man accused in Cornell rape lawsuit seeks to remove Attorney General Letitia James from the investigation.

A New York judged hearing the argument issued a no ruling on the efforts, citing the other six accused Chi Phi fraternity members as reason.

The defendant cites James' social media posts, where she describes the alleged ordeal as "horrific and unacceptable."

The judge says consideration needed to be made as to whether it is legally viable for one out of seven defendants to have a different prosecutor. The court has asked the requesting defendant to submit further details in by November 5 to explain why the six other men named in the suit had not joined the challenge to seek their participation.
